All of the information on the Website is by its nature generic. All patients have different dental requirements, so therefore we strongly recommend that you speak to a qualified dentist/orthodontist if you have a problem or query. You should not place any reliance on any advice placed on this Website or act in reliance of it. The Implant Foundation makes no warranty or representation that any of the information on the Website is accurate, complete or current or that it contains no technical or typographical errors. The Implant Foundation excludes all liability for the content on the Website, howsoever arising and of whatever nature (whether direct or indirect or consequential) to the fullest extent permitted by law.
If you are acting in your capacity as a consumer your statutory rights are not affected by these terms and conditions.
Whilst The Implant Foundation makes all reasonable attempts to exclude viruses and other malicious code from the Website, The Implant Foundation accepts no liability for viruses or damage caused by viruses or the like and strongly recommends that you have appropriate virus screening software in place at all times.
Except as explicitly stated otherwise, any notices given by you by email should be addressed to email@example.com Any notices given by us to you will be addressed to your registered email address. Such notice shall be deemed to have been given and received 24 hours after the email is sent, notwithstanding the fact that the sending party may be notified that the email address is invalid for any reason (including the possibility that the email address in your registration details is incorrect or out of date). Alternatively, The Implant Foundation may give you notice by registered post to the address provided to us during the registration processes and you may give us notice by registered post to our registered office. In such case, notice shall be deemed to have been given and received 3 days after the date of mailing.
The Implant Foundation reserves the right to vary these terms and conditions from time to time. Such changes shall either be notified to you by email or posted on the Website. Such changes in this manner shall be deemed to have been accepted by you if you continue to use the Website after a period of two weeks from the date of transmission of the email or of the posting on the Website, whichever occurs later.
Contracts (Rights of Third Parties) Act 1999
Except as expressly provided in these terms and conditions, a person who is not a party to the terms and conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of these terms and conditions provided that this does not affect any right or remedy of the third party which exists or is available apart from that Act. Notwithstanding the provisions of this clause, The Implant Foundation shall have the right to enforce any term of this Agreement jointly with or separately from any action which The Implant Foundation may take.
These terms and conditions contain the entire agreement and understanding of the parties in connection with the use of the Website. This acknowledgement shall not apply to any misrepresentations and/or breaches of warranty which constitute fraud.
If any term or provision in these terms and conditions shall be held to be illegal or unenforceable in whole or in part under any enactment or rule of law such term or provision or part shall to that extent be deemed not to form part of these terms and conditions but the validity and enforceability of the remainder of these terms and conditions shall not be affected.
Waiver and cumulative remedies
No failure to exercise or delay in exercising any right or remedy under this Agreement shall constitute a waiver thereof and no waiver by The Implant Foundation of any breach or non-fulfillment by you of any provision of these terms and conditions shall be deemed to be a waiver of any subsequent or other breach of that or any other provision hereof. No single or partial exercise of any right or remedy under this Agreement shall preclude or restrict the further exercise of any such right or remedy and the rights and remedies of The Implant Foundation provided in these terms and conditions are cumulative and not exclusive of any rights and remedies provided by law.
These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Each of the parties hereby irrevocably submits to the exclusive jurisdiction of the courts of England and Wales.
